How Pennsylvania clears a record
Three paths. Most people qualify for at least one.
Pennsylvania has some of the strongest record-clearing laws in the country. Which one fits depends on the charge, its grade, how the case ended, and how long you’ve stayed out of trouble. We sort that out case by case.
Expungement
The record is destroyed, as if the case never happened.
- Charges withdrawn, dismissed, or found not guilty
- Summary offenses after 5 arrest-free years
- ARD and probation-without-verdict completions
- Age 70+ and 10 years free of arrest or prosecution
- Pardoned convictions
Limited access by petition
Convictions are sealed from employers, landlords, and the public.
- Many misdemeanors and some lower-grade felonies
- A conviction-free waiting period, now 7 years for most cases
- Restitution must be paid
Clean Slate
Automatic sealing run by the courts and State Police.
- Non-conviction records
- Summary convictions after 5 years; many misdemeanors after 7
- Certain lower-level drug felonies after 10 years

Questions
What people ask first.
If Clean Slate is automatic, why do I need a lawyer?
Clean Slate only covers certain offenses, and it depends on complete court data. Cases with older records, unpaid restitution, or more serious grades often need a petition. Sealing also isn’t the same as expungement, and some cases qualify for full expungement.
Does sealed mean gone?
No. A sealed record is hidden from most employers, landlords, and the public, but police, courts, and some licensing agencies can still see it. Expungement removes the record entirely.
I still owe fines and costs. Can I still qualify?
Often, yes. Owing fines and costs no longer blocks automatic Clean Slate sealing. Restitution to a victim is different and usually has to be paid first.
What if my conviction doesn’t qualify?
A pardon from the Governor can lead to full expungement. It takes longer, and we’ll tell you honestly whether it makes sense for your record.
